1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "Parent," "Guardian") and EvoPhonics ("Company," "we," "us," "our"), governing your use of the EvoPhonics educational platform, website (evophonics.com), and all related applications, content, and services (collectively, the "Service").

By clicking "Sign Up," "Create Account," or otherwise accessing the Service, you represent that you are a parent or legal guardian of the child using the platform, that you are at least 18 years of age, and that you have the legal authority to enter into this agreement.

2. Description of Service

EvoPhonics provides an online educational platform that teaches American English phonics, reading, and accent training to children, primarily those between the ages of 3 and 14. The Service includes:

• A free foundation tier comprising introductory lessons available to all registered users at no cost.
• A paid subscription tier (the "Main Course") consisting of a structured 83-day phonics program, accessible upon successful payment.
• Interactive lessons, audio-visual content, progress tracking, gamified exercises, and learning assessments.
• Parent-accessible account management and progress dashboards.

We reserve the right to modify, update, or discontinue any aspect of the Service at any time, with reasonable prior notice to registered users where possible.

3. User Accounts & Registration

To access certain features of EvoPhonics, you must create an account. When registering, you agree to:

• Provide accurate, complete, and up-to-date information.
• Maintain the confidentiality of your account credentials (email and password).
• Take full responsibility for all activities that occur under your account.
• Notify us immediately at contact@evophonics.com if you suspect any unauthorized use of your account.
• Not share your account credentials with any other person or allow any third party to access the platform using your account.

You are responsible for ensuring that your child's use of the Service complies with these Terms. Account registration is for one child per account. For multiple children, separate accounts may be required.

4. Eligibility

EvoPhonics is intended for use by children under the supervision and with the consent of a parent or legal guardian. You must be at least 18 years of age to register an account and agree to these Terms on behalf of your child.

The educational content is designed for children aged 3 to 14 years. Older learners are welcome to use the platform, and the content will be adapted to their age as indicated during the sign-up process.

5. License to Use

Subject to your compliance with these Terms and payment of any applicable fees, EvoPhonics grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial, educational purposes.

This license does not include the right to:

• Reproduce, distribute, or publicly display any content from the platform.
• Reverse engineer, decompile, or attempt to extract the source code of any part of the Service.
• Use the Service for any commercial purpose, including tutoring services or classroom instruction, without prior written consent.
• Remove, alter, or obscure any copyright, trademark, or proprietary notices on the platform.

6. Acceptable Use Policy

You agree to use EvoPhonics only for lawful purposes and in a manner consistent with these Terms. The following activities are strictly prohibited:

• Attempting to gain unauthorized access to any part of the Service or its underlying systems.
• Sharing account credentials, enabling multiple simultaneous users on one account, or circumventing our single-device security system.
• Uploading, transmitting, or distributing any harmful, offensive, or illegal content.
• Using automated bots, scrapers, or any tool to extract content or data from the platform.
• Impersonating any person or entity or providing false information to EvoPhonics.
• Attempting to interfere with, disrupt, or damage the Service or servers.

Violation of this Acceptable Use Policy may result in immediate account suspension or termination without refund.

7. Payment, Subscriptions & Billing

The EvoPhonics platform offers a free foundation tier and a paid Main Course subscription. The following terms apply to all paid subscriptions:

• All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless otherwise stated.
• Payment is due at the time of purchase and is processed through our secure third-party payment gateway.
• Access to paid content is granted immediately upon successful payment confirmation.
• Prices are subject to change. Any price changes will be communicated before they apply to existing subscriptions.

8. Intellectual Property

All content on the EvoPhonics platform — including but not limited to text, audio, video, illustrations, graphics, curriculum materials, lesson structures, exercises, and the EvoPhonics name and logo — is the exclusive intellectual property of EvoPhonics and is protected under the Copyright Act, 1957 (India) and applicable international copyright law.

Nothing in these Terms transfers any intellectual property rights to you. Any unauthorized use, reproduction, or distribution of our content without prior written permission constitutes infringement and may result in legal action.

9. Disclaimers & Warranties

The EvoPhonics Service is provided on an "as is" and "as available" basis. While we strive for the highest quality, we make no warranty that:

• The Service will be uninterrupted, error-free, or available at all times.
• The educational content will produce specific results or improvements in any child's language skills within a defined timeframe.
• The Service is free from viruses or other harmful components (though we take all reasonable precautions).

Learning outcomes depend on many factors including the child's age, prior exposure, consistency of practice, and parental involvement. EvoPhonics provides the tools and curriculum; results require the child's active participation.

10. Limitation of Liability

To the maximum extent permitted by applicable Indian law, EvoPhonics shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service.

In any event, our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the total amount paid by you to EvoPhonics in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

11. Account Suspension & Termination

EvoPhonics reserves the right to suspend or terminate your account and access to the Service at any time, with or without notice, if:

• You violate any provision of these Terms or the Acceptable Use Policy.
• You engage in fraudulent activity or attempt to circumvent our payment or security systems.
• Required by applicable law or a governmental order.

You may terminate your account at any time by contacting us at contact@evophonics.com. Upon termination, your right to access the Service will cease immediately. Please note that termination does not entitle you to a refund — see our Refund Policy for full details.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, specifically the laws applicable in the State of Maharashtra, without regard to its conflict of law provisions.

Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts in Jalgaon, Maharashtra, India.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we do, we will update the "Effective Date" and provide reasonable notice to registered users via email at least 14 days before changes take effect.

Your continued use of EvoPhonics after the updated Terms become effective constitutes your acceptance of the changes. If you do not agree with the modified Terms, you must discontinue use of the Service before the effective date.
